We discuss four interconnected issues that we believe have hindered investigations into how language may affect thinking. These have had a tendency to reappear in the debate concerning linguistic relativity over the past decades, despite numerous empirical findings. The first is the claim that it is impossible to disentangle language from thought, making the question concerning “influence” pointless. The second is the argument that it is impossible to disentangle language from culture in general, and from social interaction in particular, so (...) it is impossible to attribute any differences in the thought patterns of the members of different cultures to language per se. The third issue is the objection that methodological and empirical problems defeat all but the most trivial version of the thesis of linguistic influence: that language gives new factual information. The fourth is the assumption that since language can potentially influence thought from “not at all” to “completely,” the possible forms of linguistic influence can be placed on a cline, and competing theories can be seen as debating the actual position on this cline. We analyze these claims and show that the first three do not constitute in-principle objections against the validity of the project of investigating linguistic influence on thought, and that the last one is not the best way to frame the empirical challenges at hand. While we do not argue for any specific theory or mechanism for linguistic influence on thought, our discussion and the reviewed literature show that such influence is clearly possible, and hence in need of further investigations. Beneficence is a foundational ethical principle in medicine. To provide benefit to a patient is to promote and protect the patient’s wellbeing, to promote the patient’s interests. But there are different conceptions of wellbeing, emphasizing different values. These conceptions of wellbeing are contrary to one another and give rise to dissimilar ideas of what it means to benefit a patient. This makes the concept of beneficence ambiguous: is a benefit related to the patient’s goals and wishes, or is it a (...) matter of objective criteria that constitute wellbeing? This paper suggests a unified conception of wellbeing for use in medicine to determine what counts as a benefit. Two components of wellbeing are identified: (1) objective functioning/health and (2) the patient’s view of her own good. The paper explores how to apply, balance, and weigh these components in clinical situations to determine what counts as a benefit to a patient. (shrink)

For many years the prevailing paradigm for medical decision making for children has been the best interest standard. Recently, some authors have proposed that Mill’s “harm principle” should be used to mediate or to replace the best interest standard. This article critically examines the harm principle movement and identifies serious defects within the project of using Mill’s harm principle for medical decision making for children. While the harm principle proponents successfully highlight some difficulties in present-day use of the best interest (...) standard, the use of the harm principle suffers substantial normative and conceptual problems. A medical decision-making framework for children is suggested, grounded in the four principles. It draws on the best interest standard, incorporates concepts of harm, and provides two questions that can act as guide and limit in medical decision making for children. (shrink)

Transparency is a crucial condition to implement a CSR policy based on the reputation mechanism. The central question of this contribution is how a transparency policy ought to be organised in order to enhance the CSR behaviour of companies. Governments endorsing CSR as a new means of governance have different strategies to foster CSR transparency. In this paper we discuss the advantages and disadvantages of two conventional policy strategies: the facilitation policy and the command and control strategy. Using three criteria (...) (efficiency, freedom and virtue) we conclude that both strategies are defective. Most attention is paid to the facilitation strategy since governments nowadays mainly use this. In evaluating this strategy we analyse the Dutch case. As an alternative we introduce a third government policy: the development of a self-regulating sub-system. By construing an analogy with the historical development of corporate financial disclosure, we point out that the vital step in the creation of a self-regulating subsys- tem is the creation of strong informational intermediate organisations. This work clarifies the role of the best interest standard (BIS) as ethical principle in the medical care of children. It relates the BIS to the ethical framework of medical practice. The BIS is shown to be a general principle in medical ethics, providing grounding to prima facie obligations. The foundational BIS of Kopelman and Buchanan and Brock are reviewed and shown to be in agreement with the BIS here defended. Critics describe the BIS as being too demanding, narrow, opaque, (...) not taking the family into account and not suitable as limiting principle. This work responds to these criticisms, showing that they do not stand up to scrutiny. They either do not apply to the BIS, only apply to misuses of the BIS or criticise a BIS that is not seriously defended in the literature. (shrink)

Some propositional attitude verbs require that the complement contain some “subjective predicate”. In terms of the theory proposed by Lasersohn, these verbs would seem to identify the “judge” of the embedded proposition with the matrix subject, and there have been suggestions in this direction. I show that it is possible to analyze these verbs as setting the judge and doing nothing more; then according to whether a judge index or a judge argument is assumed, unless the complement contains a subjective (...) predicate, the whole matrix is redundant or there is a type conflict. I further show that certain clear facts argue for assuming a judge argument which can be filled by a contextually salient entity–or by the subject of a subjective attitude verb. (shrink)

The overarching topic of this dissertation is the semantics and pragmatics of definite descriptions. It focuses on the question whether sentences such as ‘the king of France is bald’ literally assert the existence of a unique king or simply presuppose the existence of such a king. One immediate obstacle to resolving this question is that immediate truth value judgments about such sentences are particularly unstable; some elicit a clear intuition of falsity whereas others simply seem awkward or strange. Because of (...) these variations, truth value judgments are generally considered unreliable. In the first chapter of the dissertation, an explanation of this phenomenon is developed. It is observed that when these types of sentences are considered in the context of a discourse, a systematic pattern in judgments emerges. This pattern, it is argued, should be explained in terms of certain pragmatic factors, e.g. whether a speaker’s utterance is interpreted as cooperative. A detailed and general explanation of the phenomenon is then presented which draws importantly on recent research in the semantics and pragmatics of questions and focus. It is shown that the behavior of these judgments can be systematically explained, that truth value judgments are not as unreliable as standardly assumed, and that the proposed explanation best supports the conclusion that definite descriptions presuppose rather than assert existence. In the second chapter, the following problem is investigated. If definite descriptions are assumed to literally assert existence, a sentence such as ‘Hans wants the ghost in his attic to be quiet’ is incorrectly predicted to be true only if Hans wants there to be a ghost in his attic. This prediction is often considered evidence against Russell’s quantificational analysis and evidence in favor of the referential analysis of Frege and Strawson. Against this claim, it is demonstrated that this problem is a general problem about the existence commitments of natural language determiners, i.e. not an argument in favor of a referential analysis. It is shown that in order to avoid these undesirable predictions, quite radical changes to the semantic framework are required. For example, it must be assumed that a sentence of the form ‘The F is G’ has the open sentence ‘x is G’ as its asserted content. A uniform quantificational and presuppositional analysis of definites and indefinites is outlined which by exploiting certain features of so-called dynamic semantics unproblematically assumes that the asserted contents indeed are open sentences. In view of the proposed quantificational/presuppositional analysis, the dissertation is concluded by a rejection of the argument put forward by Reimer and Devitt that definite descriptions are ambiguous between attributive and referential uses. Reimer and Devitt’s argument is based primarily on the assumption that definite descriptions are conventionally used to communicate singular thoughts and that the conventional meaning of a definite description therefore must be fundamentally indexical/directly referential. I argue that this argument relies crucially on tacit assumptions about semantic processing for which no empirical evidence is provided. I also argue that the argument is too general; if sound, it would be an argument for an indexical treatment of most, if not all, other determiners. I then conclude by demonstrating that the view does not explain any new data and thus has no clear motivation. In short, this dissertation provides a detailed pragmatic explanation of a long-standing puzzle about truth value judgments and then outlines a novel dynamic semantic analysis of definites and indefinites. This analysis solves a significant problem about existence commitments — a problem that neither Russell’s nor the Frege/Strawson analysis are equipped to handle. This analysis is then defended against the claim that definite descriptions are ambiguous. (shrink)

Questions related to end-of-life decision making are common in clinical ethics and may be exceedingly difficult. Chief among these are the provision of cardiopulmonary resuscitation (CPR) and do-not-resuscitate orders (DNRs). To better address such questions, clarity is needed on the values of medical ethics that underlie CPR and the relevant moral framework for making treatment decisions. An informed consent model is insufficient to provide justification for CPR. Instead, ethical justification for CPR rests on the rule of rescue and on substituted (...) interest judgments. Patients’ known wishes and values are relevant, particularly in protecting them from unwanted CPR. Clinicians should rescue patients with the means at their disposal, as a prima facie moral imperative, unless there are compelling reasons to refrain. We present a moral framework for making decisions regarding CPR and DNR. (shrink)

Game logics describe general games through powers of players for forcing outcomes. In particular, they encode an algebra of sequential game operations such as choice, dual and composition. Logic games are special games for specific purposes such as proof or semantical evaluation for first-order or modal languages. We show that the general algebra of game operations coincides with that over just logical evaluation games, whence the latter are quite general after all. The main tool in proving this is a representation (...) of arbitrary games as modal or first-order evaluation games. We probe how far our analysis extends to product operations on games. We also discuss some more general consequences of this new perspective for standard logic. (shrink)

There can be little doubt about the ethical imperative to ensure adequate vaccination uptake against certain infectious diseases. In the face of vaccine refusal, health authorities and providers instinctively appeal to coercive approaches or increased education as methods to ensure adequate vaccine uptake. Recently, some have argued that public fear around Ebola should be used as an opportunity for such approaches, should an Ebola vaccine become available. In this article, the author describes the difficulties associated with coercion and education when (...) addressing vaccine opposition. Both coercion and education can cause opposite effects than intended in certain circumstances. The correct area of focus is to address the breakdown in trust within clinical relationships. The author presents suggestions for an approach towards vaccine refusal that may be more promising. (shrink)

While the best interest standard (BIS) enjoys wide endorsement as the ethical and decision-making standard in pediatrics, it has been criticized as vague and indeterminate. Alternate decision-making standards have been proposed to replace or augment the BIS, notably the harm principle (HP) and constrained parental autonomy (CPA) model. In this edition of The Journal of Clinical Ethics, Lainie Friedman Ross argues that CPA is a better standard than the BIS or the HP as both guide and limiter in pediatrics. In (...) response, I review the important work done by the BIS in pediatrics, and argue that neither the HP nor the CPA can take over these functions or replace the BIS. Among other things I argue: (1) The BIS provides more robust protections for the moral claims of children. (2) The CPA model and the HP do not resolve the indeterminacy and vagueness present in complex medical situations, and the BIS is better suited to deal with this vagueness and indeterminacy. (3) The BIS is a general principle of medical ethics with special application in pediatrics; it fits seamlessly into the system of medical ethics and fulfills many functions within pediatrics. The HP and the CPA model do not fit so readily within medical ethics, and are not equipped to take over the functions of the BIS. (shrink)

The concept of the mahant- ātman-, or “vast self”, found in some of the Early and Middle Upaniṣads, has, at least since the days of Hermann Oldenberg, been explored by a number of scholars, most notably by van Buitenen :103–114, 1964). These studies have usually emphasized the cosmic implications of this concept; the vast ātman- being the non-individualized spirit that brings forth and pervades the universe, then enters the bodies of all created beings as their animating principle. As such it (...) precedes the mahān, or mahat, of the Sāṃkhya philosophy. The present paper argues that the concept of a mahant- puruṣa- or “vast person”, appearing parallel to the vast ātman in these texts, is in fact older, being traceable to Middle Vedic texts; the emergence of the Upaniṣadic ātman doctrine has eventually led to its replacement by the mahān ātmā. Originally, it is argued, the adjective mahant- stressed the difference between this “vast” puruṣa, who is said to dwell in the sun, and the minute puruṣa within man, who is seen as the tiny “person” in one’s pupil, or resides in the heart, having the size of a thumb. In contradistinction to the ātman, the puruṣa is a thoroughly anthropomorphic soul-concept, a “person” within the person. The ultimate identity between this tiny soul-person and the puruṣa in the sun is a recurring, but little studied, motif in the micro-macrocosmic speculations of the Brāhmaṇa texts. This “vast”, solar puruṣa is sometimes identified with the Puruṣa or primeval man of Ṛgveda 10.90, from whose body the universe was formed, and much of the imagery surrounding the vast puruṣa of Middle and Late Vedic literature seems to derive from this hymn. This paper examines explanations for human artistic behavior in two reductionist research programs, cognitive neuroscience and evolutionary psychology. Despite their different methodological outlooks, both approaches converge on an explanation of art production and appreciation as byproducts of normal perceptual and motivational cognitive skills that evolved in response to problems originally not related to art, such as the discrimination of salient visual stimuli and speech sounds. The explanatory power of this reductionist framework does not obviate the need for higher-level accounts of (...) art from the humanities, such as aesthetics, art history or anthropology of art. This article examines an argument which may negatively influence measles vaccination uptake. According to the argument, an individual child in a highly vaccinated society may be better off by being non-vaccinated; the child does not risk vaccine adverse effects and is protected against measles through herd immunity. Firstly, the conclusion of the argument is challenged by showing that herd immunity’s protection is unreliable and inferior to vaccination. Secondly, the logic of the argument is challenged by showing that the argument is (...) inherently self-defeating and therefore logically inconsistent. In practice the argument cannot be used to protect children against measles. Measles vaccination is undoubtedly best for children, even in highly vaccinated societies. Only if a medical contraindication to vaccination exists should vaccination be waived in favour of reliance on herd immunity. This places obligations on those who stand in care relationships with the child: parents, healthcare providers, and the state. (shrink)

Defensive medicine has become pervasive. Defensive medicine is often thought of as a systems issue, the inevitable result of an adversarial malpractice environment, with consequent focus on system-responses and tort reform. But defensive medicine also has ethical and professionalism implications that should be considered beyond the need for tort reform. This article examines defensive medicine from an ethics and professionalism perspective, showing how defensive medicine is deeply problematic. First, a definition of defensive medicine is offered that describes the essence of (...) defensive practice: clinical actions with the goal of protecting the clinician against litigation or some adverse outcome. Ethical arguments against defensive medicine are considered: defensive medicine is deceptive and undermines patient autonomy; defensive medicine subjugates patient interests to physician interests and violate fiduciary obligations; defensive medicine exposes patients to harm without benefit; defensive medicine undermines trust in the profession; and defensive medicine violates obligations of justice. Possible arguments in favor of defensive medicine are considered and refuted. Defensive practice is therefore unethical and unprofessional, and should be viewed as a challenge for medical ethics and professionalism. (shrink)

Following Darwin, many comparative psychologists assume that the human mind is a kind of ape mind, differing only in degree from the extant apes – we call this the mental continuity assumption. However, the continuity principle in evolutionary theory does not posit continuity between extant closely related species, but between extant species and their extinct ancestors. Thus, it is possible that some human cognitive capacities have no parallels in extant apes, but that they emerged in extinct hominid species after the (...) human-chimpanzee divergence. Our examination of the case of social cognition from an archaeological and comparative psychological perspective suggests that the human brain is not simply an enlarged chimpanzee brain. Instead, natural selection seems to have favoured a different social cognition in both species. (shrink)

The present article focuses on American and European personalism during the early part of the twentieth century . The immediate predecessor of the personalist movement as such was the philosopher Rudolf Hermann Lotze who inspired two of his students, Methodist Borden Parker Bowne and Rudolf Eucken. In France, in the meantime, Charles Renouvier published his Le personnalisme in 1903, while Emmanuel Mounier later presented personalism as a new political philosophy under the influence Alexandre Marc’s comments on Nicolai Hartmann’s Ethik. Mounier’s (...) Manifeste au service du personnalisme develops a dialectical critique on both liberal bourgeois individualism and all forms of collectivism, all, in his opinion, ‘inverted theocracies’ with shared dehumanizing tendencies. As alternative, it was necessary for personalism to become the leading spiritual and philosophical guide in order to Refaire la Renaissance . As a matter of fact, Jacques Maritain’s Humanisme intégral might justly be considered a first attempt to describe the nature of a new civilization in any detail. Maritain is more explicit on the Christian face of this new humanism, while refuting any kind of mancentred humanism. Mounier’s and Maritain’s personalist ideas together with Max Scheler’s non-formal ethics of value and his Aktlehre had a considerable influence on Louis Janssens. In Personne et société he not only criticizes several contemporary European ideologies in line with Mounier, but he also accepts that persons can only be really known by co-operation, in line with Scheler’s idea of inter-subjectivity and Aquinas’ idea of the social nature of the human being. Following Maritain, Janssens distinguishes between the human being as individual and the human person. Individuality contains a material component, characterized by its concrete position in space and time, while the person and his/her spiritual component facilitate a movement away from the self towards others in freedom and love. The person is not only understood as the highest value, he/she is able to control the hierarchy of values by his/her ordo amoris, a flexible undertaking influenced by the love of others in which love opens each person for growth towards higher values. In certain finite extensive games with perfect information, Cristina Bicchieri (1989) derives a logical contradiction from the assumptions that players are rational and that they have common knowledge of the theory of the game. She argues that this may account for play outside the Nash equilibrium. She also claims that no inconsistency arises if the players have the minimal beliefs necessary to perform backward induction. We here show that another contradiction can be derived even with minimal beliefs, so there is (...) no paradox of common knowledge specifically. These inconsistencies do not make play outside Nash equilibrium plausible, but rather indicate that the epistemic specification must incorporate a system for belief revision. Whether rationality is common knowledge is not the issue. (shrink)

This paper defends four lines of argument that establish an ethical obligation for clinicians to be vaccinated against COVID-19. They are: (1) The obligation to protect patients against COVID-19 spread; (2) The obligation to maintain professional competence and remain available for patients; (3) Clinicians’ role and place in society in relation to COVID-19; (4) The obligation to encourage societal vaccination uptake. These arguments stand up well against potential objections and provide a compelling case to consider acceptance of COVID-19 vaccination a (...) duty for all clinicians. This duty brings with it the implication that vaccine refusal amounts to a dereliction of the professional’s ethical obligations, which means such clinicians should be subject to disciplinary action. Furthermore, this duty provides grounding for mandatory vaccination policies for clinicians. (shrink)

This book offers a novel theory of childhood well-being as a social good. It re-examines our fundamental assumptions about parenting, parental authority, and a liberal society's role in the raising of children. The author defends the idea that the good of a child is inexorably linked to the good of society. He identifies and critiques the problematic assumption that parenting is an extension of individual liberty and shows how we run into problems in medical decision-making for children because of this (...) assumption. He develops an objective conception of what is good for a child in liberal society, drawing on the assumptions of liberty, and from here constructs a set of things that society and its members owe children. There are ways in which society should support and intervene in parental decisions to guarantee a child's well-being. Ultimately, raising children is a social activity that requires input from society. The author then applies this theory of childhood well-being to develop a framework for medical decision-making for children. He also uses practical examples, such as vaccinations, parental leave, and healthcare access, to demonstrate the implications of his theory for public policy. The Limits of Parental Authority: Childhood Wellbeing as a Social Good will be of interest to research and advanced students working in bioethics, political philosophy, and public health policy. This article presents arguments that reframe the discussion on vaccination ethics. The correct starting point for discussions on vaccination ethics is not what society owes parents, but rather what society owes children. Drawing on the justice theory of Powers and Faden, two conclusions are defended by presenting and defending a set of arguments. First, a just society is obligated to protect its children against serious vaccine‐preventable diseases such as measles through adequate levels of vaccination. Second, this obligation of the just (...) society rests on identifiable individuals and institutions: parents, healthcare professionals, government, and vaccine producers have important obligations in this regard. This removes vaccination out of the realm of individual or parental discretion, and situates it in the realm of societal obligation. Children are owed vaccination, society is obligated to provide it. If parents cannot or will not provide it, society ought to respond. (shrink)

The cosmological argument has enjoyed and still enjoys substantial popularity in various traditions of natural theology. We propose that its enduring appeal is due at least in part to its concurrence with human cognitive predispositions, in particular intuitions about causality and agency. These intuitions seem to be a stable part of human cognition. We will consider implications for the justification of the cosmological argument from externalise and internalise perspectives.

Le Poidevin’s ‘new agnosticism’ concerns partaking in religious life while being uncertain whether religious discourse is fictional or not. Le Poidevin has offered two distinct versions of the new agnosticism, ‘semantic agnosticism’ and ‘meta-linguistic agnosticism’. I suggest that the first, ‘semantic agnosticism’, should be rejected, mainly because it involves a highly questionable view of truth and fails to properly distinguish fictional existence from real existence. The second, ‘meta-linguistic agnosticism’ seems acceptable as a view of religious discourse but not as a (...) foundation for a religious life. A meta-linguistic agnostic will not be able to take the proper attitude towards religious propositions, since what is the proper attitude varies greatly between realism and fictionalism. Even more importantly, she will not know when it is rationally permissible to perform religious actions, because she will not know whether real-life concerns should take precedence or not. Le Poidevin’s meta-linguistic agnostic is also a truth-agnostic, and I conclude that adding meta-linguistic agnosticism to truth-agnosticism only complicates matters without offering any benefits. This article aims to reconstruct the normative distinction between sophistry and dialectics developed in Plato’s treatment of sophistry. We begin by describing Plato’s notion of sophistry as a knack of persuasion that succeeds by masquerading itself as truth-oriented and by providing gratification for its listeners. We then argue that the stringency of Plato’s arguments becomes clear by using his definition of sophistry as a guideline for the interpretation of the dialogues Protagoras and Gorgias. Together, these dialogues provide a well-structured argument (...) that questions the usefulness of sophistic practice, despite its effectiveness in attaining power within the Athenian democratic institutions. Plato’s fundamental critique of sophistry differs from certain misleading prejudices against sophistry, also found in Plato’s writings and challenged by historical research. The critique is therefore of lasting relevance not only to the understanding of Plato’s philosophical agenda but also to the interpretation of »the sophists«. We end by suggesting that Plato’s normative distinction between sophistry and dialectics is also of relevance for our contemporary conception of democratic discursive culture and its legitimacy.
